Last updated: 28 October 2026

Version 1.0 of 28/10/2026. This is a translation provided for information only: in case of any discrepancy, the French version prevails.

Preamble

MonRendu.com is an online service (SaaS) that turns the image exported from the rendering of a kitchen design software into a photorealistic visual. It is intended for interior fitting professionals.

During its test phase, the MonRendu.com business is carried out by Nicolas Crauc (CAPE no. 14228) and Timothée Leicht (CAPE no. 14229). Each of them benefits from a business project support contract (contrat d'appui au projet d'entreprise, CAPE) until 2 November 2027 at the latest, entered into with Espace des Entrepreneurs. Espace des Entrepreneurs is a registered French association whose registered office is at 4 rue des Buisses, 59800 Lille, France. SIRET 418 541 553 00032, intra-community VAT number FR 23 418 541 553, NAF code 88.99B, represented by its president, Christiane Lecocq.

Under these CAPE contracts, Espace des Entrepreneurs is the Client's contracting party and the issuer of invoices. In these terms, "we" refers to the MonRendu.com business carried out in this way.

Article 1. Definitions

– Service: the MonRendu.com application available online, its features and its updates.

– Client: the legal entity or sole trader who creates an account or subscribes for the purposes of their professional activity.

– Administrator: the user appointed by the Client to manage the account, the seats and the subscription.

– User: any natural person to whom the Client gives access to the Service.

– Seat: the named right of access to the Service assigned to a User.

– Source image: the image exported by the Client from its design software and imported into the Service.

– Render: the visual generated by the Service from a Source image.

– Period: the billing period of the subscription (month or quarter).

Article 2. Purpose and scope

2.1. These terms govern access to and use of the Service, as well as the subscription, invoicing and payment of subscriptions. They combine our general terms of sale and our general terms of use. Appendix 1 (data processing agreement) forms an integral part of them.

2.2. The Service is reserved for professionals who use it for their business. By creating an account, the Client declares that it is acting in a professional capacity. Consumer protection provisions, in particular the right of withdrawal, do not apply.

2.3. The Service is offered to clients established in all countries, except the United States and Canada.

Article 3. Acceptance and amendment of the terms

3.1. The Client accepts these terms by ticking the box provided when creating its account, and again before its first payment. We keep the accepted version as well as the date and time of acceptance.

3.2. We may amend these terms. Any new version is notified by email to the Administrators at least 30 days before it comes into force and must be accepted at the next login. A Client who refuses may cancel its subscription free of charge before the new version comes into force. Failing acceptance, access to the Service is limited to viewing until the end of the paid Period.

3.3. These terms prevail over the Client's purchasing conditions, unless otherwise agreed in writing and signed by both parties.

Article 4. Description of the Service

4.1. The Service allows the Client to import the image exported from the rendering of its design software, to generate photorealistic visuals from that image, to adjust them, to organise them into projects and to share them.

4.2. The Service is used once the design has been completed. It produces no plans, no quotes and no 3D models. It does not replace the Client's design software.

4.3. The Service allows the creation of presentation links that can be viewed without logging in. These links remain active until they are deleted by the Client or the contract ends. The Client is solely responsible for sharing them.

4.4. Access through an application programming interface (API), through a connector for an AI assistant, or using the Client's own AI provider key is not part of the standard offer. Such access may be granted by a written amendment.

4.5. The Service evolves. We may add, modify or remove features, provided that we do not remove the essential function described in article 4.1 during a paid Period.

Article 5. Account, Administrator and seats

5.1. The Client creates an account by providing accurate and up-to-date information, including its company name, address, country of establishment and, where applicable, its VAT number or tax identifier.

5.2. The Administrator assigns seats to Users. A seat is personal: it may only be used by the User to whom it is assigned. Sharing login credentials between several people is prohibited. The Administrator may reassign a seat to another User.

5.3. The Client is responsible for the confidentiality of its Users' login credentials and for any action carried out from its account. It informs us without delay of any unauthorised use.

Article 6. Free trial

6.1. A new Client may benefit from a free trial, without a bank card, including 20 generations on a single seat, valid for 15 days from the creation of the account. The trial ends at whichever of these two limits is reached first.

6.2. At the end of the trial without a subscription, generation is disabled and projects remain viewable for 30 days. They are then permanently deleted.

6.3. The trial is limited to one per Client. We may refuse or interrupt a trial if multiple accounts are created.

Article 7. Offers, prices and VAT

7.1. The Service is offered by subscription, billed per seat. The available offers, their prices and their tiers are those displayed on the MonRendu.com website and summarised to the Client before each payment. During the test phase, two offers are available:

– a monthly subscription;

– a 3-month offer, paid in advance for the whole quarter.

7.2. The unit price depends on the total number of seats on the account (tier). A change of tier, upwards or downwards, takes effect at the start of the following Period.

7.3. Prices are stated in euros, excluding taxes. VAT is added where applicable, according to the rules applicable at the Client's place of establishment. Any bank or currency exchange fees related to payment are borne by the Client.

7.4. We may change our prices. The new price is notified by email to the Administrators at least 30 days before it applies, and only applies from the following Period. A Period already paid is never revised. A Client who refuses the new price may cancel free of charge before it applies.

Article 8. Term, renewal and cancellation by the Client

8.1. The subscription takes effect upon receipt of the first payment, for a Period of one month or one quarter depending on the chosen offer.

8.2. It renews automatically for a Period of the same length, unless cancelled.

8.3. The Client may cancel at any time from its account. Cancellation takes effect at the end of the current Period, which remains due and gives rise to no refund, even partial. The Service remains accessible until that date.

8.4. Adding seats: a seat added during a Period is active immediately. It is billed pro rata for the number of days remaining until the end of the Period, and charged immediately.

8.5. Removing seats and changing offers: these take effect at the start of the following Period, without refund.

Article 9. Invoicing and payment

9.1. Invoices are issued by Espace des Entrepreneurs and made available to the Client electronically.

9.2. Payment by bank card. Payment is made on the secure page of our payment provider CAWL (Crédit Agricole). We never have access to the full card details. By subscribing, the Client authorises CAWL to store its card and to charge it automatically at each due date for the amount of the following Period, as well as the pro rata amounts provided for in article 8.4.

9.3. Payment by bank transfer. With prior agreement, the subscription may be paid by bank transfer to the account of Espace des Entrepreneurs, quoting the reference shown on the invoice. The invoice is payable within 15 days of its issue date.

9.4. Invoices are payable in advance, at the start of each Period. No discount is granted for early payment.

9.5. Failed or late payment.

– If a charge fails, we inform the Client by email and make a new attempt 3 days and then 7 days after the due date.

– For payment by bank transfer, reminders are sent 3 and 7 days after the invoice due date.

– The Client may settle at any time from its account.

– If no payment has been made 15 days after the due date, access to generation is suspended. Projects remain viewable. Access is restored as soon as payment is made.

9.6. In accordance with article L.441-10 of the French Commercial Code, any sum not paid by the due date automatically entails, without prior reminder:

– late payment penalties at a rate of 15% per year;

– a fixed indemnity for recovery costs of €40 (article D.441-5 of the French Commercial Code).

Article 10. Fair use

Each seat is intended for the normal professional use of one designer. The subscription does not include a number of generations billed per unit. Beyond fair use, assessed in particular with regard to a volume of 200 renders per seat per month, we may lower the processing priority of that seat's generations until the end of the current month, at no extra charge. Unused generations are not carried over from one month to the next.

Article 11. Rules of use

The Client and its Users undertake in particular not to:

– resell, rent or make access to the Service available to third parties;

– produce Renders on behalf of other professionals as a service. Renders are intended for the Client's own customers;

– share a seat between several people, or multiply accounts to circumvent fair use or the free trial;

– import content for which they do not hold the rights, or content that is unlawful, defamatory or infringes the rights of third parties;

– attempt to circumvent the technical measures of the Service, extract its code, reverse-engineer it or disrupt its operation;

– automate access to the Service by means other than those we provide;

– use the Service from the United States or Canada, or on behalf of clients established there.

Article 12. Client content and ownership of Renders

12.1. The Client retains all its rights to the Source images it imports. It warrants that it holds the rights necessary to use them in the Service, including for any catalogue items, textures or brands they contain.

12.2. For the term of the contract, the Client grants us the non-exclusive right to use its Source images and Renders solely to the extent necessary to provide the Service: storage, processing, generation, display and sharing at its request.

12.3. Renders generated for the Client belong to it to the fullest extent permitted by law. It may use them freely, without limitation in time or territory, including after the end of the contract. Content produced by artificial intelligence may not be protected by copyright: we guarantee neither the originality nor the exclusivity of a Render.

12.4. We do not reuse any Render or Source image of the Client for communication or promotional purposes without its express consent, given for each use or through an option it activates in its account.

12.5. Neither we nor our subcontractors use Source images or Renders to train an artificial intelligence model.

Article 13. Our intellectual property

The Service, its code, its interface, its databases, its generation instructions, and the MonRendu.com name and logo are our exclusive property. The contract grants the Client a personal, non-exclusive and non-transferable right of use, limited to the term of the subscription and to the number of seats subscribed. No other right is transferred.

Article 14. Nature of Renders and information of the end customer

14.1. Renders are mood visuals generated by artificial intelligence, intended as a sales aid. They are neither construction documents nor contractual documents. Colours, materials, lighting, proportions and decorative elements may differ from the final result, and the AI may introduce elements that are not part of the project.

14.2. The Client undertakes to present Renders to its own customers as non-contractual visuals, and not to use them as a technical or dimensional reference. It remains solely responsible for the compliance of its offer and of its commitments to its customers.

Article 15. Availability, maintenance and support

15.1. We use reasonable means to ensure access to the Service 24 hours a day, 7 days a week. We are bound by an obligation of means and do not guarantee any availability rate. The Service relies on third-party providers, in particular for image generation, whose unavailability may delay or prevent generation.

15.2. The Service may be interrupted for maintenance. We notify Administrators by email in advance whenever possible.

15.3. Support is provided by email at contact@monrendu.com and through the reporting form built into the Service. We endeavour to respond within 2 business days. This timeframe is indicative.

Article 16. Liability

16.1. Our liability may only be incurred in the event of proven fault, for direct damage suffered by the Client.

16.2. We are not liable for:

– indirect damage, such as loss of revenue, customers, reputation or data;

– the use the Client makes of Renders, in particular with its own customers;

– differences between a Render and the final result;

– content imported by the Client;

– interruptions caused by a third-party provider, the internet network or a force majeure event.

16.3. For all causes combined, our liability is limited to the amounts actually paid by the Client for the Service during the three months preceding the event giving rise to liability.

16.4. The Client is responsible for its content and for the use of the Service by its Users. It indemnifies us against any third-party claim resulting therefrom.

Article 17. Suspension and termination for breach

17.1. If the Client breaches its obligations, in particular under articles 5.2, 9 and 11, we may terminate the contract 15 days after a formal notice that has remained without effect, sent by email with acknowledgement of receipt or by registered letter.

17.2. In the event of a serious threat to the security or operation of the Service, or of manifestly unlawful content, we may immediately suspend the access concerned, and then inform the Client.

17.3. Termination for breach does not give rise to any refund. Amounts due remain payable.

17.4. The Client may terminate the contract under the same conditions in the event of a serious breach on our part. It is then refunded for the unused portion of the current Period.

Article 18. Personal data

18.1. For account, billing and business relationship data, we are the data controller. This data is used to manage the account, the subscription, invoicing, support and information about the Service. It is kept for the duration of the contractual relationship and then for up to 3 years afterwards, unless a longer retention period is required by law (accounting records).

18.2. For Source images, Renders and any data the Client includes in them, the Client is the data controller and we act as a processor, under the conditions of Appendix 1.

18.3. Any data subject has a right of access, rectification, erasure, restriction, objection and portability. They may exercise it by writing to contact@monrendu.com, subject "Data subject rights". If there is reasonable doubt as to their identity, proof of identity may be requested. They may lodge a complaint with the CNIL (cnil.fr).

Article 19. Confidentiality

Each party keeps confidential the non-public information received from the other under the contract, and uses it only for its performance, for the whole term of the contract and for two years after its end. This obligation does not apply to public information or to information whose disclosure is required by law.

Article 20. Commercial reference

The Client authorises us to mention its name and reproduce its logo as a commercial reference, on our website and in our presentation documents. It may object at any time by email to contact@monrendu.com. This authorisation does not cover its Renders, which are governed by article 12.4.

Article 21. End of the contract and fate of data

21.1. At the end of the contract, for whatever reason, generation is disabled. Projects remain viewable and downloadable for 30 days.

21.2. After this period, accounts, Source images, Renders and presentation links are permanently deleted, except for data we are required by law to keep (invoicing, accounting).

21.3. It is the Client's responsibility to download its Renders before this deletion.

Article 22. Assignment of the contract

22.1. The MonRendu.com business is intended to be taken over by a company being incorporated, NiTi Tech (SARL). The Client agrees now that the contract may be assigned as of right to that company, or to any company that takes over the business, on the same terms.

22.2. The Client is informed by email at least 30 days before the assignment, with the identity of the assignee. It may cancel free of charge before the assignment date. Otherwise, the contract continues with the assignee.

22.3. The Client may not assign the contract without our prior written consent.

Article 23. Force majeure

Neither party is liable for a failure caused by a force majeure event within the meaning of article 1218 of the French Civil Code. If the impediment lasts more than 30 days, either party may terminate the contract by email, without compensation. The Client is then refunded for the unused portion of the current Period.

Article 24. Governing law, disputes and language

24.1. The contract is governed by French law, whatever the Client's country of establishment. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

24.2. In the event of a dispute, the parties seek an amicable solution for 30 days from written notification of the dispute by either of them.

24.3. Failing agreement, exclusive jurisdiction is granted to the courts of Lille (France), including for summary proceedings, third-party claims or multiple defendants.

24.4. These terms are drawn up in French. They are translated into other languages for information purposes: in case of any discrepancy, the French version prevails.

This appendix governs the processing we carry out on behalf of the Client, as data controller, in connection with the Service.

2. Description of the processing

Where data is processed outside the European Union by a sub-processor, or where the Client is established outside the European Union, the transfer is governed by an adequacy decision of the European Commission or, failing that, by the standard contractual clauses adopted by it.
